Dear Tj White,
I have spoken to your vet this morning about Eclair. He informed me there was no Eclair registered in your name, only a Lucy and Sunny. I had to give her microchip id for them to be able to locate her and it took a while. It is important that Eclair’s name remain the same. If you want to add Lucy to her name and call her Lucy that is fine. But for registration purposes with the AKC and Avid Microchip she must remain as registered—
The vet informed me he saw no indication of “broken teeth ” on her record but that she did require a dental with possibly 5-6 teeth pulled which was not uncommon in a dog 5-6 yrs old. You vet is also able to do the needle aspiration and perform a biopsy, which you thought he could not do. It is a fairly common procedure. The mammary , he said was more than likely benign. But to be on the safe side he would like to send it off for tests. We hope that Eclair’s results are good.
Kentucky Dachshund Rescue, Inc. adopts out somewhere between 100-150 dogs each year…. Our dogs come from a. owner surrenders b. shelters c. breeders d. puppy mill court cases.
Our contract specifically states what we provide for all pets coming in and adopted out from KDR.

KDR agrees to the following:

1. To assist in transferring the Dog to the Adopter via automobile relay via the courtesy of our members and/or volunteers. Commercial carrier transports are subject to the discretion of KDR, or a representative thereof, and can be refused as a mode of transport to ensure the health and well being of the Dog.

2. To provide a Dog that is current on Rabies and DHPPC vaccines.

3. To provide a Dog that has been spayed or neutered unless otherwise noted above, free from intestinal worms, heartworms and currently on heartworm preventatives. (SEE ADDENDA ON SPAY)

Adopter agrees to the following:

10.. To provide and finance all medical care and treatment needed by the Dog beginning at the time Adopter assumes physical custody of the Dog KDR has tried to assess the condition of this Dog but makes no guarantees since long-term health histories are rarely available.

and

Adopter understands and acknowledges full responsibility for the future medical and/or healthcare of the Dog from the date Adopter assumes physical custody of the Dog , and releases KDR and representatives thereof, from any future financial, legal and/or medical responsibility for the Dog. Adopter further understands that KDR, and representatives thereof, cannot guarantee future temperament, behavior, size or medical condition(s) of the Dog.

Our web site says we provide

ADOPTION FEE INCLUDES: FULL VETERINARY CHECK-UP
TEST FOR WORMS (includes heartworm)
UP TO DATE ON ALL SHOTS
SPAYED/NEUTERED
DENTALS (when necessary)
OTHER NECESSARY MEDICAL PROCEDURES
that means if a vet deems it necessary upon examination
After having spoken to your vet, it is marginal who is responsible for the dental work for Eclair. However, we did agree to pay our maximum amount that we allow in Kentucky.
I was contacted today by you and told a stop payment has been placed on the check to pay KDR for Eclair. Whether bank error or not, there is a $30 return check fee. Please include it in your money order that you send.
Your vet has also requested the xrays from Central Ky vet . They will be mailed to your vet in cd form and there is a charge of $20 for the cd.
He will be called and informed of the charge prior to mailing.
Records I have here have that have been mailed to you included: Rabies certificate, innoculation record, xray billing and report. Eclair did not come from a “puppy mill”. If you have doubts I would suggest you read the www.hsus.com
site where you can explore some valuable information on breeders vs. puppy mills. The breeder who you contacted was treated terribly and accused of mistreating Eclair. Such was definitely not the case. Eclair received excellent care. She was only bred for 5 yrs., kept utd on all shots , dewormed and microchipped. The breeder even had her on meds for a skin problem prior to surrender. She deserves and apology.- at the very least. We do not give out the information of where our dogs originate for that reason. Adopters sometimes misconstrue the reason a dog was surrendered. Eclair was never abused or neglected and she was socialized inside a private home. To prejudge someone and relay that information is slander. The breeder’s reputation is her livelihood.
Payment: I was informed today that the check that was stopped was a bank error. Your bank will be glad to verify that. Stop payment by the adopter is a breach of contract. (See last page of contract)
We try to maintain good contact with our adopters. You have agreed to provide her with specific things. However, KDR does not step away once an adoption happens. We continue to monitor all the pets we adopt for many years. That is why a good relationship is so important between the rescue and the adopter. 9. To not abandon the dog under any circumstances nor to give away, sell or trade the dog .
Each item in our adoption contract has been scrutinized for accuracy. Our main goal is to make an adoption a happy one for our adopters and the pets they adopt.
I hope we will receive your money order promptly as we are planning our fundraiser in Ind next weekend at the Midwest Doxie Festival and will need the funds to purchase items to help raise funds for our rescue.
Each year we provide 5-6 back surgeries for doxies in need at a cost of $3,000 each. Our adoption fees barely cover the vetting costs on each dog. So the fundraisers help us raise money to pay for the much needed surgeries.
Your stop payment has delayed our much needed funding for these projects.
Our hopes is that Eclair has found a wonderful permanent home with folks who will love and care for her and also be able to appreciate what rescue is all about.
Kathy McIntosh, pres. Kentucky Dachshund Rescue, Inc.

Get a load of this crap. She acts like we are liars and don’t know what the hell we are talking about.

WOW, she must have taken lessons from Patti at Keystone. There is that slander word again. Tj and Jessi I am so glad LUCY has found you two alomng with Sunny. We all know she will be well taken care of and loved very much. Hmmmmm, I think you both know what your vet said about her condition and I would get a copy of her records. I know you cant change her name at AKC but you can in your home. By the way we like Lucy not Eclair. That is a donut. Good luck to your family and please keep us posted we are all here for you!

  2. Comment by doxhoont:

Umm I might also add that you CAN change the registration on a microchip so I would do so a.s.a.p. Pay these idiots their blood money and move on with your lives. Why is that they can NOW find her records when they couldn’t be responsible enough to Lucy in the first place especially when you two had driven 9 hours each way to get her.

Do your best to re-register the microchip!

As for your contacting the breeder!?!?!?!? THESE IDIOTS left her name and number in the bag with the special shampoo for Heaven’s Sake!!!

Okay and one more - it doesn’t seem as if they anwered anything about NOT knowing she was spayed already.

We’ll thank the good Lord above that Lucy is now safe and sound in your loving care and we’ll PRAY for the Kentucky Dachhsund Rescue that they learn something from this incident.

I am SO happy you got Lucy, especially away from all of that. The person who wrote this letter not only called YOU a cheat and your vet and the breeder a liar, they also made it sound as if it was all your fault. As much as I believe in these organizations, one such as theirs needs to be put out of business. They could also save a lot of money if they didn’t go to Indiana and stayed where they are and take better care of the animals they were entrusted with.

noooo i dont want them in indiana. tell them to stay in ky. i sure hope everything goes well for you. i was still great of you to rescue the sweet baby.

  6. Comment by RR&G:

I agree with Laura that changing her name on the microchip is no problem and I would get it done.

Either your vet is telling you one thing and her another, or somebody is lying. Grrrr!

TJ and Jessi, you both have been through so much. Thank you for opening your heart and home to this little girl. I’m SO VERY sorry this has been a bad experience for you. Stories like this help me renew my commitment to be the best rescuer I can be and only take on what I can handle. We can’t get sloppy…. ever.

Love to you and your furkids..
